A mistrial has been declared in the trial of a 70-year old Garden Grove man who fatally shot a homeless man in 2023 who had thrown a shoe at him.
According to published reports, the jury on his involuntary manslaughter charge on Wednesday deadlocked 11-1 and was unable to reach a verdict. It was not announced whether a new trial would be ordered.
Craig Sumner Elliot, then 68, is alleged to have fired shots that killed Antonio Garcia Avalos after the latter threw a shoe at him.
Elliot was jogging along Katella Avenue with his two dogs at round 3 p.m. on Sept. 28, 2023 when he encountered the man, and an incident took place over passage on the sidewalk.
