A 40-year-old Westminster man was sentenced Friday to 75 years to life – plus five years – in state prison for the 2015 gunshot murder of his uncle.
According to the Orange County District Attorney’s office, Daniel Lee Duvall received his sentence in Central Justice Center in Santa Ana. He had been convicted on Feb. 23 of one count of first degree murder, with a sentencing enhancement for personal discharge of a firearm causing death.
Duvall had prior convictions for possession of a firearm by a felon in 2002, a residential burglary in 1996 and possession of a firearm by a felon in 2007.
Duvall was at a birthday party for Tina Pauline Arbogast, 49, at her home in Westminster on March 8, 2015. At around 10 p.m., he got into an argument with his uncle, Frank Duvall, 56, inside the home.
According to the OCDA, the nephew brandished a firearm and followed his uncle out to the man’s van. He then shot the victim once in the torso, wounding him fatally.
Arbogast then allegedly took Daniel Duvall’s firearm and drove away, fleeing the scene in her own vehicle, while Daniel left on his motorcycle. They then drove to Riverside County.
Westminster police tracked the two to a gated community in Canyon Lake and arrested them.
Arbogast has been charged as an accessory after the fact, and is scheduled to appear in court for a pre-trial hearing on Sept. 20. If convicted, she faces a maximum sentence of three years in state prison.
