Robert Rundo, a 33-year-old Huntington Beach resident accused of recruiting and training others to commit violent acts at political rallies across Southern California, is back in federal custody after being ordered released on Wednesday.

His case had been dismissed by U.S. District Judge Cormac J, Carney claiming the federal prosecutors were involved in “selective prosecution” by charging right-wing militants but not those on the left.

But the 9th Circuit Court of Appeals on Thursday responded to a emergency request from the U.S Attorney’s office by blocking his release. But he had already been discharged, so a second emergency request was made and approved.

Rundo was arrested by federal officers on Thursday, according to the U.S. Attorney’s office.

It was the second time that cases against Rundo were dismissed by Judge Carney on the grounds of “selective enforcement.”
