
TWO MEMBERS of the Westminster City Council are being sued for alleged “disruptions” of council meetings (Shutterstock).
The Westminster City Council has taken the extraordinary step of filing a lawsuit attempting to rein in what its majority members call “disruptive” actions of members Amy Phan West and NamQuan Nguyen.
The lawsuit, filed on Nov. 27 in Orange County Superior Court (Central), claims that the defendants “have repeatedly disrupted meetings of the council” and that efforts of the mayor to “manage their unruly behavior” were unsuccessful and “repeated efforts to obtain their compliance have failed.”
Both West and NamQuan Nguyen are being “sued in their personal capacity” and therefore won’t be able to be defended in court by the city.
The filing goes on to cite specific incidents of alleged disruption, with violations of state and city codes.
The council – acting on behalf of the city – is asking for a temporary restraining order and permanent injunctions to keep the defendants from violating rules of decorum and appropriate codes.
Additionally requested is a declaration that the defendants “may be lawfully removed from the council meetings” for speaking when they do not have the floor.
The city is also asking for attorneys’ fees and court costs to be paid by defendants.
The controversy at the meetings is a long-standing issue. The council majority has voted to censure and sanction the two defendants to no avail.
