President Donald Trump’s taking control of the California National Guard to assist in immigration enforcement and dispatching them to the Los Angeles area is unlawful, according to a federal judge.

On Thursday, U.S. District Judge Charles Breyer issued a temporary restraining order from San Francisco and ordered Trump to return the troops to California authority. The federal government has filed an appeal with the Ninth Circuit Court.

The Associated Press is reporting that Breyer held in his ruling that Trump had violated the 10th Amendment to the U.S. Constitution and exceeded his authority as president.

Gov. Gavin Newsom sued the block the deployment of the Guard over the objections of himself – as commander-in-chief of California troops – as well as Los Angeles Mayor Karen Bass.

Air India crash kills hundreds

A Boeing 787 passenger jet crashed shortly after takeoff in India on Thursday and was carrying 242 passengers. Only one of those board is said to have survived, according to The New York Times.

The plane went down in Ahmedabad. Observers said that while the jet was descending, its nose was pointing upward, an unusual position. The cause of the crash is unknown and the U.S. is sending a team to India to help in the investigation.

One possible factor could be the high temperature – 100 degrees – which can make it harder for planes to ascend.
