President-elect’s Donald Trump’s request to have his “hush money” conviction dismissed was rejected on Monday. According to the Associated Press. The request was based on the U.S. Supreme Court’s ruling that a president acting in his official duties could not be convicted of a crime.
But Manhattan Judge Juan Merchan – who presided over the trial in which Trump was convicted in May of 34 felony changes related to filing false financial statements – said that Trump was acting as a private individual when he made payments of $130,000 to a porn actress to not reveal alleged sexual contact with him.
The judge described Trump’s payments as “decidedly personal acts” that didn’t intrude on “the authority and function of the Executive Branch.”
